Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Coca Cola Enterprises, Little Rock AR: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with the operation of powered industrial trucks (forklifts) without the use of operator restraint systems (seat belts). A feasible and acceptable means of abatement to correct this hazard is as follows: Develop, implement, and enforce a workrule requiring forklift operators to wear seat belts at all times while operating a forklift.
