North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)work site, western storage tank -- employer did not ensure that the supervisor determined the presence of combustible materials and hazardous areas present or likely to be present in the welding and/or cutting work location. NOTE:Among other methods of abatement, one feasible and acceptable method is for employer to specifically test for hazards associated with DMT.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)work site, western storage tank -- the employer did not ensure that the supervisor scheduled the welding and/or cutting to ensure that plant operations that might expose combustibles to ignition were not started during the welding and/or cutting. Dimethyl Terepthalate, (DMT), storage tanks were in use during welding at the time of the accident. NOTE:Among other methods of abatement, one feasible and acceptable method is to discontinue use of the DMT in the storage tank and remove the DMT from the tank before welding and cutting operations are begun on the tank.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)work site, Western DMT storage tank--a lockout/tagout program was not developed and utilized to ensure the supply of inert gas was maintained in the tank during welding operations being conducted on the DMT venting system. NOTE:Among other methods of abatement, one feasible and acceptable method is to develop, maintain and utilize lockout/tagout procedures during all welding operations being conducted on the DMT storage tanks.e
