Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falling hazards:
a) Furniture Warehouse,  on or about November 12, 1999.   An employee was
operating
a Clarklift Orderpicker Model No. OP15, Serial No. OP15-0177-PM9296 to
place and
remove furniture from shelf 14' from concrete floor.  Employee did not
have safety belt
and lanyard on when he stepped from the platform of the Clarklift
Orderpicker onto the
top shelf of Aisle AT.
ABATEMENT CERTIFICATION REQUIRED
One feasible abatement method, among others, is to ensure employees are
fastening
safety belts and lanyards when they are on the platform of the
orderpickers
and when they step
off of the platform onto shelves.  Enforce the use of safety belts and
lanyards at all times when
employees are operating the orderpickers. Develop and implement a written
policy on the use
of safety belts and lanyards while operating the orderpickers.
