Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from employees not being restrained in a forktruck in case of tipping over and/or rollover: a)On or about 11/22/99, employees operating Toyota forktrucks, equipped with seatbelts, are not wearing protective restraint devices (seatbelts). The forktrucks are driven in the vicinity of open-sided docks and are entering truck bodies while moving freight. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WEAR THE SEATBELTS THAT ARE PROVIDED, AS REFERENCED IN ASME B56.1 - 1993 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS" AND OSHA'S NEW POWERED INDUSTRIAL TRUCK OPERATOR TRAINING STANDARD. ABATEMENT DOCUMENTATION REQUIREDATION
