Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  In
December 1999, the
employer did not furnish a place of employment which was free from
recognized hazards that
were likely to cause death or serious physical harm to employees in that
employees
attempting to drape the hold down chain over the foot pad of a rail car
were exposed to
injuries if caught between equipment during the car dumping operation.
The purpose of this
procedure was to assure that the railcar would not slip off the railtrack
while being dumped.
During the procedure, the employee might come between the car dumping
machine and the
railcar, which was directly above the foot pad of the car, a space of
about 11 inches, where
it was difficult to be seen from the operator's normal position at the
opposite end of the
machine.
Feasible abatement methods may include one or more of the following:
1) Install a system which would consist of a fixed plate which the rail
car
foot pad would be
under when the car is in position for dumping.  Such a system had been
used on an earlier
Kenny Kiewit Shea site.
2) Install a hydraulically activated system which allows for the operator
to extend a plate
over the railcar foot pad from the operator's station.
3) Require the operator to drape the chain as well as activate the machine
thus eliminating
the need for anyone else to be in the area.
