Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish a place of employment which was free from recognized hazards that
were likely to
cause death or serious physical harm to employees. Employees were exposed
to the tipping
hazard of the material delivery truck due to the inadequate placement of
the stabilizers.
On or about April 7, 2000, at the above addressed jobsite, stabilizers
were set on top of
brick, drywall dunnage and 4x4's in order to extend the reach of the arm
of the machine.
Feasible abatement methods include, but are not limited to:
1.) Positioning the equipment on firm level ground to ensure stability
while operating with
loads as stated in the manufacturer's operations manual.
