Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to : On or about April 26, 2000, at the worksite located at 1958 Washington, Chicago, IL., an employee working from an extensible boom aerial lift (self propelled) while stripping existing roofing material at a height of approximately 20 feet was exposed to the hazards of falls due to the lack of personal fall arrest equipment. Among feasible means of abatement would be to comply with the American National Standards Institute (ANSI) A92.5-1992 Standard for Boom-supported Elevating Platforms and have employees wear fall arrest equipment whenever they are in an aerial lift.
