Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by moving equipment: On or about February 17, 2000, the employer did not ensure that the employee preparing to operate the backhoe implement on a John Deere 310E backhoe loader had moved the FNR lever and gear shifter to the neutral position and had engaged the park brake as required by the operator's manual. Among other methods, one feasible and acceptable method is to: Ensure that employees preparing to operate the backhoe implement move the FNR lever and gear shifter to the neutral position and engage the park brake as required by the operator's manual, OMT164770 F8, page 35-1.
