Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: struck by hazards while operating a scissors lift in an
area where fork-lift
traffic was present.
An employee operating an MEC scissors lift, model #: 2034, serial #:
8102413 outside the North
door entrance/exit to the holding freezer was struck by a Raymond Electric
Narrow Aisle Lift
Truck, Model 31 SCR, Serial#: EZA 9605315 and did not provide warnings to
alert fork-lift
operators to his presence including but not limited to, flags, roped off
area(s), flashing lights or
barricades.  Operators of scissors lifts are required to utilize warning
systems whenever working
in the same area as moving equipment per ANSI standard A92.6-1990, section
8.10.2.
This
accident occurred at The Pillsbury Company located in Hazelwood, Missouri
on 1/18/00.
Feasible and effective abatement can be expected to include, but is not
limited to:
1) Purchasing and/or utilizing warning systems to include; safety cones,
barricades, warning
lights and warning tape whenever scissors lifts are used in areas where
other moving equipment
is present.
2) Implement a written company policy which would include training to all
affected employees
regarding the mandatory use of warning systems whenever employees utilize
a scissors lift in
an area where moving equipment is present.
