Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)Employee working on the first floor of this establishment was able to
bypass (open) the
elevator gate while the elevator was on the upper level (second floor).
Employee fell ten
(10) feet down the elevator shaft to the concrete floor of the basement.
Among the methods, one feasible and acceptable abatement method to correct
this hazard
is to repair the interlocks on the elevator gates so that they cannot be
bypassed (opened)
when the elevator is on another floor. This elevator should comply with
the requirements
for elevators as set forth in the American National Standards Institute
(ANSI) A17.2-
1960 including the following:
The closed position of the door or gate electric contacts used with either
separate
mechanical locks or combination mechanical locks and electric contacts
should be
determined as outlined for interlocks in section 100.2(b) of ANSI Standard
A17.2-1973.
Determine that from this position the door cannot be reopened from the
landing side. The
closed position should conform to the applicable code rules.
Abatement certification and abatement documentation is required for this
violation.  The
documentation should include written verification of abatement, applicable
measurements
or monitoring results, and photographs or videos which you believe will be
helpful.  The
abatement certification sheet is enclosed with the citations(s).
