North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)facility; clarity department - Gorbel vaccum below the hook lifting device has not been load tested b)facility; oil house - 55 gallon drum below the hook lifting device has not been load tested. REFERENCE: ANSI B30.20 -1985 paragraph 20-1.4.2 Rated Load Test (a)...Prior to initial use, all new, altered, modified, or repaired lifting devices should be tested and inspected by or under the direction of a qualified person.... NOTE: One feasible means of abatement is to have all below the hook lifting devices load tested.

REFERENCE: ANSI/ASME B30.11-1998 paragraph 11-2.2.2 Load test (a) New, reinstalled, altered, repaired and modified equipment should be load tested prior to initial use as determined by a qualified person... NOTE: One acceptable and feasible means of abatement is to have the monorail system load tested.
