Title 40.1-51.1.(a), Code of Virginia:  The employer did not furnish
employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in
that:
(a) The speed limit of 25 miles per hour for unloaded switcher tractors in
the truck yard is excessive,
especially during times of reduced illumination.  During the inspection,
it was found that the employer had voluntarily
reduced the lighting in the yard by 25to placate the neighbors cattle.
Additionally, a survey of two other trucking
companies found that the maximum allowable speed for any switcher tractor
is 15 miles per hour in their yards.
Therefore, one feasible and acceptable abatement method, among others, to
correct the hazard is to reduce the
maximum allowable speed of unloaded switcher tractors to 15 miles per hour
at all times.
