Section 40.1-51.1(a) of the Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: University of Virginia, Department of Cell Biology, Jordan Hall, laboratory room 3218, on 5/2/2000, several syringes with needles attached, containing chemical residue, were left on a shelf, such that the needles were protruding over the shelf edge. The laboratory personnel work with recombinant DNA. According to the "Laboratory Survival Manual" (and the National Institute of Health), Biosafety Level 2 special practices are required, including sharps precautions. One feasible abatement method to correct the hazard includes but is not limited to using a tray to contain sharps while not in use.
