Section 40.1-51.1(a) of the Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Lifecare Medical Transports, Inc., 1701-D, Allied St., Charlottesville, VA., employees are exposed to the hazard of being infected with Mycobacterium tuberculosis through unprotected contact while transporting patients who were infectious or suspected to be infectious with tuberculosis. Patients with TB are transported by employees. The employer had not developed a TB infection control plan to protect employees per Center for Disease Control guidelines. Feasible and useful abatement methods include but are not limited to written protocols for identifying and managing patients who may have active TB, employee respiratory protection, and PPD screening, and employee training.
