Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of: Being struck by falling steel storage racks or the components of the steel storage racks to include any materials stored in them. a) The employer did not insure the metal racks were installed and maintained in accordance with the manufacturer's requirements. The manufacture utilizes ANSI MH16.2-1984 in their instructions to the installer/user. The requirements of "American National Standards, Manual of Safety Practices- A Code of Safety Practices for the Use of Industrial and Commercial Steel Storage Racks", were not met in that: Section 1, Part 1.3 Collision Protection- The user did not immediately repair portions of the rack that had been struck and bent by industrial truck(s), on or about 2/11/00. Section 1, Part 1.4 Base Plates And Anchoring- There were some rack sections that the base plates had no anchoring provide, on or about 2/11/00. Section 1, Part 1.5d Beam And Shelf Connections- Some rack beams and shelf connections did not have connection devices to lock them in or as an alternative bolting of the beams and shelves, on or about 2/11/00. Section 2, Part 2.2 Proper Erection and Plumbness- Racks were not erected strictly in accordance with the manufacturer's instructions. The owner/user did not have any instructions or know the name of the manufacturer, on or about 2/11/00. ***ABATEMENT VERIFICATION IS REQUIRED***N
