Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being crushed by a forklift truck in the event of a
rollover:
a)Throughout the facility:Employee who operated a forklift truck and load
and unload trucks that
are exposed to a tipping hazard were not required to wear protective
restraint devices (seatbelts)
that were equipped on the Power Industrial Truck.
Violation observed on or about 12/19/00.
ABATEMENT NOTE:AMONG OTHER MEANS , ONE FEASIBLE AND ACCEPTABLE
METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO REQUIRE
EMPLOYEES TO UTILIZE THE SEATBELTS AND ADD THIS REQUIREMENT TO THE
EMPLOYEES TRAINING PROGRAM.
