Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by forklift truck in the event of a rollover: a)Warehouse: Employee who operate forklift trucks, who is required to load and unload trailers, and exposed to a tipping hazard, was not required to wear protective restrain devices (seatbelt) that was equipped on Powered Industrial Trucks. Violation observed on or about 12/20/00. ABATEMENT NOTE:AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO REQUIRE EMPLOYEES TO UTILIZE THE SEATBELTS AND ADD THIS REQUIREMENT TO THE EMPLOYEES TRAINING PROGRAM.
