Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by forklift trucks in the event of a rollover: a)Receiving Area:Employees who operate forklift trucks, who load and unload trucks that are exposed to a tipping hazard were not required to wear protective restraint devices (seatbelts) that were equipped on Powered Industrial Trucks. Violation observed on or about 6/12/01. ABATEMENT NOTE:AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO REQUIRE EMPLOYEES TO UTILIZE THE SEATBELTS AND ADD THIS REQUIREMENT TO THE EMPLOYEES TRAINING PROGRAM.
