Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; specifically: Where employees work underneath vehicles on automotive lifts during the repair of vehicles, the employer did not institute a lift inspection program to assure that these lifts were safe to operate. Specific concerns noted on December 27, 1999 were that the concrete floor below one lift was cracked and damaged, the weight of a modified truck on a lift rated for 9000 pounds was unknown, and no routine inspections were being done.
