MN Statute 182.653 Subd.2 - The employer did not furnish to each employee,
conditions
of
employment and a place of employment free from recognized hazards which
caused or were
likely to cause death or serious injury to employees, specifically:
Two employees were working on a forklift basket without using personal fall
protection.  The forklift had a telescopic boom & tilt carriage, and the
forklift basket
was missing the front guardrail.

The operator left the forklift unattended while another employee was
hoisted up 11
feet to the work zone.  Also, the platform was not secured to the mast of
the forklift
while both the operator and the worker were working inside the work
platform.
