Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees. On February 10, 2000 employees were exposed to fall hazards of approximately 20 feet while standing on the top rail of a scissors-lift type self-propelled elevating work platform being used at the Lecture Hall loading dock area of the Charter House addition under construction in Rochester. The employee was not wearing any personal fall arrest equipment.
