Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by the forklift in the event of a rollover: a) Warehouse Floor: Employees not required to wear seat belts when operating forklifts. Violation observed on or about 3/22/00. ABATEMENT NOTE:A feasible means of abatement is to inform employees of the requirement to wear seat belts, require employees to wear the seat belts and enforce the use of seat belts.e
