Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
a)Employees were transported to and from an 18-foot high roof by means of
a platform
which did not meet the requirements of the American National Standards
Institute Safety
Standard for Rough Terrain Forklift trucks, ASME B56.6-1992, sponsored by
the
American Society of Mechanical Engineers.  The platform failed to meet the
requirements in the following areas:
1)The platform did not have a toe plate (4-inch minimum required),
2)It did not have the maximum work load and platform weight prominently
indicated on the platform,
3)It did not have a means to securely attach the platform to the lifting
mechanism
and,
4)It had guardrails with a height of 38 inches above the floor, rather
than the
required 42 inches.  The guard chain at the entrance opening was only 28
inches
above the floor.
Among other methods, one feasible and acceptable means to correct these
hazards is to assure
that the design, manufacture and use of all attachments for Rough Terrain
Forklift Trucks is in
accordance with the most current version of ASME B56.6 (presently
B56.6-1992) and/or has the
prior written approval of the lift truck manufacturer.  Another means of
safe access may also
be substituted for the vehicle and platform.
