Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that machine operators
were exposed to the hazards of machine failure of malfunction due to the
lack of required
machine inspections and preventative maintenance:
a)  Regular and periodic inspections and preventative maintenance were not
performed on the company's machines to include, but not limited to the
Nichols
Mill Machine.
Among others, one feasible and acceptable method to abate this hazard is
to establish machine
inspection and maintenance schedules, and to perform such inspections and
maintenance as
required by the machine manufacture.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.
