Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)Employees were observed working inside a personnel work
platform without wearing their personal fall arrest system
(Harnesses with attached lanyards). This Condition exposed the
employees to a fall hazard of 30-feet to the lower ground level at
a REHAB/Construction project located at the corner of W. Van
Buren St. & W. Ogden Ave.; Milwaukee, Wisconsin.
One or more acceptable feasible abatement methods could be achieved by
following:
SAFETY STANDARD FOR ROUGH TERRAIN FORK LIFT TRUCKS (ANSI B56.6-1992)
CHAPTER 5, section 5.15 - Elevating personnel.
If a rough terrain forklift truck must be used to lift people, the
following precautions for the
protection of personnel shall be taken in steps (a) through (y) of this
subpart.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.
