Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that a boom supported
elevated work platform aerial lift was used in a work area where there
were physical
obstructions to the safe operation of the lift:
(a)The employer did not ensure on or about August 23, 2001, that his
employees were free from hazards while operating a boom
supported elevated working platform in a work area located on the
corner of W. Cherry Street & N. Commerce Street; Milwaukee,
Wisconsin.
Among others, feasible and acceptable methods of abatement include:
In accordance with American National Standard Instituted (ANSI) A92.5 - For
Boom Supported Elevated work Platforms. Section 13.1- Before Operation.
Sec. 13.1.2 Prior to use on each work shift, the work platform shall be
inspected
for defects that would effect its safe operation and use. The inspection
shall
consist of the following:
1) Visual inspections for cracks, welds, or other structural defects.
2) Function tests of the operating controls to ensure that they perform
their
intended functions.
Sec. 13.1.3  Before the work platform is used and during use,the job site
shall
be checked for hazards such as: Floor obstructions, ditches, drop offs or
holes,
bumps, debris, overhead obstructions, and other hazardous conditions.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.
