Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)On or about March 14, 2002, at a residential construction complex
located at 938 Parkton Drive, Waukesha, Wisconsin, an employee
was observed working on top of a personnel work platform
without the use of fall protection.  This condition exposed the
employee to a fall hazard of more than ten (10) feet to the ground.
One feasible abatement method, among others, is:
Following the procedures and methods in SAFETY STANDARDS FOR ALL TERRAIN
FORKLIFT TRUCKS (ANSI B.56.6-1992) CHAPTER 5, Section 5.15- Elevating
Personnel.
Feasible means and methods of correction among others could have been
achieved by following
the "JBC All Terrain Forklift" owner/operators manual, or by following the
guidelines
stated
in ANSI B 56.6 1992.  If the rough terrain forklift truck must be used to
lift personnel, the
following precautions for the protection of personnel shall be taken in
steps (a) through (y),
including but not limited to:  a) a personnel lift that meets the
requirements of part III (Lifting
platform shall not have a width greater than the overall width of the
truck plus 10 inches on
either side); b) be certain that the platform is securely attached to the
lifting carriage or forks;
k) be certain that required restraining means such as railings, chains,
cables, body belts, and/or
body harnesses w/lanyard(s), etc, are in place, and properly used; s) a
trained operator shall be
in position to control the rough terrain forklift truck or available to
operate if the platform is not
equipped with controls.
Certification, with date and method of abatement required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted
within ten (10)
calendar days after the abatement date.
