Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harms in that an
employee was exposed
to a fall hazard.
(a)On or about March 27, 2002, an employee removing gutters on the east
elevation of the Stewart-Peterson building in West Bend, WI, was elevated
to a height of 26 feet, on a lifting platform with out any means of fall
protection.  Three sides of the manufactured guardrail system had been
removed and were sitting at the job site and the exposed employee was not
protected from falls by means of a Personal Fall Arrest System of which
the employer had on site two complete sets.  The forklift operator was not
on, near or around the forklift but rather the operator was in the attic of
the building assisting the employee on the lifting platform.
A feasible means and method of correction among others could
have been achieved by following the Sky Track Rough Terrain
Forklift owner/operator manual (on site at the time of inspection)
and observing the posted warning decals on the forklift. The
employer could also have abated by following the ANSI B56.6-
1992 Safety Standard for Rough Terrain Forklift Trucks, Part 5.15
Elevating Personnel 5.15.1 (a) through (y), including but not
limited to:  (a) a personnel lift that meets the requirement of Part
III (the lifting platform shall not have a width greater than the
overall width of the lift truck plus 10 inches on either side; (b) be
certain that the platform is securely attached to the lifting carriage
or forks; (k) be certain that required restraining means such as
railings, chains, cable, body belt(s) with lanyard(s), etc. are in
place and properly used; (s) a trained operator shall be in position
to control the rough terrain forklift truck or available to operate
controls if the platform is not equipped with controls.
No certification required.  Violation Abated.on
