Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On April 23, 2002, at Albany-Chicago Company, the employer did not enforce the use of the operator restraint device on the GC-25 Caterpillar powered industrial truck which exposed employees to the hazard of being crushed by the forklift should it overturn. The hazard of entrapment of the operator and the ground is recognized by the current consensus standard, ASME/ANSI B56.1a-1989 Addenda to ASME/ANSI B56.1-1988, and ASME B56.1-1993 Safety Standard for Low Lift and High Lift Trucks. One feasible and useful method to correct this hazard is to enforce the use of the operator restraint/seat belt with which the forklift is equipped. No certification required. Violation Abated.on
