North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to: flying pieces of metal
a)shop-employer did not provide employee with written
training rules for hydrostatical leak testing a chlorine
tank with a working pressure of 500 psi which resulted in
the employee filling tank with 3200psi causing the tank
to explode injuring the employee.
Among other methods, one feasible and acceptable
abatement to correct the hazard would be to provide
written instructions for hydrostatical leak testing tanks
by:
1. determine the working pressure of the tank.
2. lower the leak test from 500psi to 100psi.
3. use the building air compressor system which can be
set at 100psi, 500psi or 1000psi.
