North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the potential for injury due to the hazard of being struck by automobiles supported on above ground lifts (Reference: ANSI/ALI B153.1-1990): a)site, garage, lift bay - above ground hydraulic lift, Model # SP09-100, SN CC096A0157, capacity 9,000 pounds, with Rotary Hydraulic Unit, Model # AB-1089-E, S/N P702085179, 230V AC,19 amps, 2450 PSI, the brake stop inoperative. One feasible and acceptable method, among others, to eliminate this hazard is to meet the requirements of ANSI/ALI B153.1 and the owner/maintenance manual.
