North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falling overhead loads: a)facility, shop, loading/unloading area - employees were allowed to stand in close proximity of and reach underneath hoisted loads, i.e., electric motors, of overhead hoists and appurtenance that were not load rated. Employees used several chain hoist such as but not limited to a CM Valustar 2-tons, Load Star 2- tons, Kohnezuc 7.5-tons, and a CM 3-tons chain hoists that were used to hoist loads, i.e., electric motors, to perform loading and unloading activities. One feasible and acceptable abatement method, among others, to correct this hazard is to load rate the hoists and appurtenances to ensure that they can withstand the rated load capacity.
