North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from falling to lower elevation: a)Wal-mart jobsite - employees who used a MEC, model# 2033ES, scissor-lift, were not required to use the lift's mid-rail. One feasible and acceptable abatement method, among others, to correct this hazard is to require employees to use the scissor-lift mid-rail.
