Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fire hazard due to alternately using a spray booth as a drying booth in which the surface temperature of the booth is increased, without following the requirements of NFPA 33, Standard for Spray Application Using Flammable or Combustible Materials, 1995 Edition. Spray Finishing Department - (a) The spray booth/drying booth was not protected with an approved fire extinguishing system as required by NFPA 33, Section 7-1. (b) The spray booth/drying booth was not adequately cleaned to minimize the accumulation of combustible deposits, especially the heavy accumulation of deposits on the motor which controls the waterwash system, as required by NFPA 33, Section 11-3.1.1. (c) Interlocks were not provided to prevent spraying operations while the heating process was in operation, nor were there interlocks to prevent the heater from being turned on while the spraying process is in operation, as required by NFPA 33, Section 11-3.1.4. (d) Two 55 gallon drums remained in the spray booth/drying booth during the heating process in violation of NFPA 33, Section 11-3.1.5. (e) A warning sign was not posted indicating that ventilation shall be maintained during the drying, curing or fusing period and that spraying shall not be conducted in the vicinity in such a manner as to deposit residue on the apparatus, as required by NFPA 33 Section 11-4.
