Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:being pinned under, crushed, or thrown from a forklift during an accident with the truck due to not wearing the seat belt provided: as required in ASME B56,1-1993. a)Loading Dock: employees were operating industrial fork trucks without wearing seat belts. Among other methods, one feasible and acceptable method to correct this hazard is to train employees and ensure employees use the seat belts provided when operating a forklift truck as referenced in ASME B56.1-1993.
