Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the possibility of being pinned under, crushed, or thrown from a forklift during an accident with the truck due to not wearing the seat belt that was provided as required in ASME B56.1-1993: (a)Throughout the workplace, where employees operate a Toyota forklift truck that was equipped with a seat belt, without utililzing the seat belt, on or about 6/15/00 and 6/21/00. Among other methods, one feasible and acceptable method to correct this hazard is to train employees and insure that employees use the seat belts provided when operating a forklift truck as referenced in ASME B56.1-1993.
