Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of entrapment of the operator between the truck and the ground in the event of a tipover. a)At the jobsite on or about 6-12-2000, an employee was observed driving a GEHL brand Rough Terrain Forklift, model #883, with the seatbelt not being used. ABATEMENT: One feasible means of abatement, among others, is to enforce the use of seatbelts on all forklifts equipped with them. ABATEMENT CERTIFICATION IS REQUIREDATION
