Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)02/07/01, an employee was observed driving a Daewoo Model 630S-3 forklift truck (Serial Number 99-00620) without a restraint device being used, thereby exposing the employee to serious injury as a result of entrapment of the operator's head and/or torso between the truck and the floor in the event of a tipover. b)02/07/01, an employee was observed driving a Daewoo Model 625S forklift truck (Serial Number 99-00492) without a restraint device being used, thereby exposing the employee to serious injury as a result of entrapment of the operator's head and/or torso between the truck and the floor in the event of a tipover. ABATEMENT NOTE: One feasible means of abatement, among others, is to train employees on the use of seat belts on forklift trucks and subsequently enforcing seat belt usage on all forklift trucks that are equipped with them. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
