Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)4/9/01, an employee was observed driving a Hyster Model H80C forklift truck without a restraint device being used, thereby exposing the employee to serious injury as a result of entrapment of the operator's head and or/torso between the truck and the floor in the event of a tip over. ABATEMENT NOTE: One feasible means of abatement, among others, is to train employees on the use of seat belts on forklift trucks that are equipped with them. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
