Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the front end loader when it was operating in reverse: a) Waste transfer station: Caterpillar model 950F front end loader had an obstructed view of the rear and operated in reverse with a defective reverse signal alarm that was not distinguishable from the surrounding noise level during operation in the transfer station bay on or about August 1, 2000. The back-up alarm was operable at the beginning of the shift and the day after according to the Operator Checklist. Feasible and acceptable abatement methods, among others, to correct the hazard are to: 1) The employer shall ensure the work rule for inoperable back-up alarms is effectively communicated and strictly enforced under the company safety and discipline programs. 2) Retrain operators and surrounding personnel about the hazard of working in the proximity of the loader; 3) Retrain maintenance personnel and equipment operators on the program for written records of action taken. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment or a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by the front end loader in the event of it turning over: a) Waste transfer station: Caterpillar model 950F front end loader TS7 with serial number 5SK3188 and Caterpillar model 950F front end loader TS8 with serial number 5SK3229 operating on a ramp to access the pit area to pick up waste material, and equipped with certified roll over protection, was not provided with approved tires that did not void the certification of the roll over protection. The employer did not obtain approval from the manufacturer to show that the use of solid rubber tires and the additional weight of the tires would not change the safety capacities of the roll over protection. Among other methods, feasible and acceptable abatement methods to correct this hazard are to utilize the tires recommended by the manufacturer or contact the manufacturer of the equipment and have their engineers perform appropriate testing to insure that the original safety factor of the Roll Over Protection System (ROPS) or a Fall On Protection System (FOPS) has not been reduced.
