Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
The hazard of falling from a road striping machine while working on an
open platform at the
rear of the machine.  On 10/3/00, there were no chains, guardrails or
seats with seat belts
available for an employee while picking up cones from the center of the
roadway.
On or about 10/3/00, at worksite,
a)Employee was exposed to hazard of falling from road striping machine
while
picking up cones from the center of the road and placing them on the east
bound
side of the road due to working on road striping machine which didn't
provide
chains, guardrails, or a seat with a seat belt to prevent employee from
falling
from moving vehicle.
Note:  Feasible and acceptable abatement measures, among others, to
correct this
hazard would be to install chains, guardrails, and/or seat with a safety
belt to
secure employee to vehicle.
