Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of fire and explosion during underground
storage tank removal
procedures such as, but not limited to, cutting holes in tanks containing
flammable liquids: One
feasible and acceptable abatement method, among others is to design and
implement a safety
program which includes provisions for the identification, evaluation and
control of fire and
explosion hazards associated with underground storage tank removal.
Elements to include a).
Tank assessment, b). control of flammable vapors using methods described
in American
Petroleum Institute Recommended Practice 1604 "Closure of Underground
Petroleum Storage
Tanks", c). application of direct reading devices to ensure flammable
vapors, toxic gases are
eliminated and ambient oxygen levels are maintained for safe operations.
