Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion hazards: a) Drum Plant - Employees sprayed #2 fuel oil onto the enclosed Black conveyor and Inclined (Main) conveyor during end of day clean up procedures in order to soften the hot, residual asphalt on the conveyors. On or about 6/26/01, the vapors from the #2 fuel oil ignited, causing an explosion within the conveyors.
