Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls to a lower level: a)Rear storage area of Wal-Mart Store - Employee was using a damaged 6 foot Keller, Model 776, Type I, Industrial Ladder to access the top of a freezer, 8 feet 7 1/2 inches above the next lower level, on or about 12/31/01. Feasible and acceptable methods of abatement are: 1.Conduct employee training on the Rules of ladder Use as per ANSI A 14.5 and the sticker on the side of the ladder. 2.Conduct ladder inspections as per ANSI A 14.5.
