THE CITATIONS ISSUED ON FEBRUARY 7, 2001, ARE HEREBY AMENDED TO READ: Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): Every employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. The employer failed to ensure that a Periodic Qualified Inspection was conducted on the Spirit 3 VBM automotive lift (Model 28,000, Serial No. 2818150), located in the third stall from the west wall on the south side of the shop. An inspection of the automotive lift in accordance with, 5. Periodic Qualified Inspection; ANSI/ALI ALOIM Standard for Automobile Lifts, Safety Requirements for Operation, Inspection and Maintenance., would have enabled the employer to identify a non-functioning lock on the east side of the lift. Feasible Abatement: Development of an inspection program in accordance with: ANSI/ALI ALOIM Standard for Automotive Lifts, Safety Requirements for Operation, Inspection and Maintenance.
