Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): Every employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. The employees in the maintenance shop area are exposed to hazards while using the 1 Ton Load Star Lobe Star E-Hoist serial number 1-1275W in that it had not had a thorough periodic inspection as referenced in ASME/ANSI B30.16-1987 Overhead Hoists (Underhung). Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): Every employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. Employees in the maintenance shop area are exposed to hazards associated with the use of schedule 40 PVC pipe for delivery of compressed air. Mode of failure for this type of piping is explosion wit sharp projectiles. Use of Schedule 40 PVC is contrary to : Section 842.32, 842.43 and 949.52(b) of the American National Standards Institute/American Society of Mechanical Engineers (ANSI/ASME) Standards B31.8-1986, Gas Transmission and Distribution Piping System Standard: American Society for Testing Materials (ASTM) D1785-86, Standard Specifications for Polyvinyl Chloride Plastic Pipe, Schedules 40, 80, and 120; and ASTM D2513-86a, Standard Specification for Thermoplastic Gas Pressure Piping Systems.
