THE CITATIONS ISSUED ON JANUARY 28, 2002, ARE HEREBY AMENDED TO READ: Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): Every employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. Two (2) hydraulic two post, in-ground automobile lifts located on the west side of the garage have not received a periodic qualified inspection within the previous twelve (12) months exposing employees to hazards associated with unsafe automobile lifts. Use of hydraulic automobile lifts without periodic qualified inspections is contrary to American National Standards Institute/Automotive Lift Institute, Inc. Automotive Lift Operation, Inspection and Maintenance-2000 (ANSI/ALI ALOIM) Standard 5.5 which states the owner shall ensure that inspection points presented in 5.6.1 are inspected by a qualified lift inspector as a minimum annual requirement. As evidence of abatement, employer must provide written documentation of inspections on two (2) hydraulic automobile lifts to the New Mexico Occupational Health and Safety Bureau.
