Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): Every employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. The 2 ton electric overhead hoist located on the main floor and attached to the 25 ton overhead traveling bridge crane was not subject to periodic inspections. One feasible and acceptable abatement method includes but is not limited to complete inspections performed at one to twelve month intervals as specified in section 16-2.2.1.3 of the American National Standards Institute/American Society of Mechanical Engineers (ANSI/ASME) Safety Standards for Cranes, Derricks, Hoists, Hooks, Jacks, and Slings ANSI B30.16-1973, or as specified by the manufacturer.
