Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety
Act):  Every
employer shall furnish to each of his employees employment and a place of
employment which
are free from recognized hazards that are causing or are likely to cause
death or serious physical
harm to his employees.
At the waste water treatment plant, 4201 2nd St. SW, the Encon combination
eyewash/shower stations located throughout the facility are not provided
with
potable water.
Not providing potable water for eyewash or shower stations is contrary to
ANSI
Z358.1 1998 section 9.4.4, which states: "The unit shall be connected to a
system
capable of supplying adequate flushing fluids (potable water per
definitions)
to
meet the requirements of each component as outlined in Sections 4, 5, 7,
and 8
when all components are operated simultaneously.
As evidence of abatement, the employer must send documentation to the New
Mexico
Occupational Health and Safety Bureau of test showing potable water is
being used on
eyewash/shower stations throughout the establishment.

Occupational Health
and Safety Bureau.
