Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) the hazards of falls while working from an elevated platform. An employee was exposed to a 6 foot fall while standing on a platform which was elevated by a forklift and supported a Galbreath self dumping hopper. The hopper was not operating correctly and which, the employee had to climb on top of the forklift and on to the pallet in order to engage the lever to release the contents of the hopper into the trash bin. among other feasible and useful abatement methods, one method would be to ensure that the hopper lever is working correctly, and to prohibit employees to stand on fork truck supported platforms.
